Terms of Service for Real Estate Agents

GENERAL
  1. The online ordering system is now available. We will not accept orders via SMS, as these are often overlooked or forgotten by the end of the day. When placing orders, you should receive a confirmation email.
  2. All properties must be ready before Meldon Media arrives. Please move or remove any furnishings in advance. Additional fees may apply if our team has to wait for rearrangements. We can provide photography checklists to help with organisation.
  3. If the Agent or Agent’s representative cannot attend the shoot, the home will be photographed as is. Meldon Media will remove minor items like tea towels and dish racks and select the best photos for the package. A callout fee will apply for any additional images needed.
  4. If Meldon Media is asked to return to the property to take extra photos, there will be a minimum callout fee of $220.00
  5. Meldon Media may complete a shoot before the expected time.
  6. Meldon Media might capture additional images outside the property’s package limits, which may not be included in the final images delivered.
  7. Meldon Media in no way assumes liability for modifications to images after delivery of photos.
  8. Meldon Media reserves the right to use any photos, property videos, and floor plans for advertising and promotional purposes.
CANCELLATION POLICY
  1. If a Meldon Media service appointment is cancelled 12 – 24 hours before its scheduled time, a 50% fee of the contract price will apply.
  2. If a Meldon Media service appointment is cancelled 12 or fewer hours before its scheduled time, 100% of the contract price will apply.
  3. In the event of rain, we will allow you to reschedule at our next availability. If the shoot continues as planned and is called off once at the property, a callout fee may apply for the return visit.
PHOTOGRAPHY
  1. Photos are generally ready by 5 pm the following day after the shoot. Please give notice if needed earlier.
  2. An excess charge may be applied if the Agent has excessive artistic input into the shoot.
  3. By accepting these terms, you agree to pay for any extra images requested at the extra image rate listed on our price list.
FLOORPLANS
  1. Meldon Media floor plans are for marketing purposes only and may not be used as a legal document.
  2. Floor plans are generally ready within 24 hours of the shoot. Please give notice if needed earlier.
  3. Meldon Media may use previously drawn plans as a reference, but no discount is given.
PROPERTY VIDEO
  1. Meldon Media creates these videos using its creative license. While we accept input from the Agent, excess charges may apply for requested re-edits.
  2. Meldon Media may use its branding at the end of any property video for promotional purposes.
  3. Meldon Media may refuse to use the Agent’s drone footage unless they can prove a CASA-qualified pilot took it.
  4. Property Videos are generally ready within 72 hours of the shoot time.
360° VIRTUAL TOURS
  1. Tours will remain online for 12 months unless additional hosting time has been purchased.
  2. Tour re-scans will be a chargeable service.
  3. Tours of holiday rentals may be unlisted if the yearly renewal has not been paid.
  4. Tours can take 3+ hours, depending on light. Tours work best on overcast days.
DRONE
  1. Safety First!
  2. The pilot may cancel/reschedule the booking if they feel the conditions are unsafe.
  3. The pilot may overrule the Agent’s requests if they exceed the guidelines set by CASA.
  4. If the property is a unit or apartment, the Agent is responsible for notifying the other residents that a drone shoot will be occurring. If this isn’t done, the pilot may cancel/reschedule the booking.
PAYMENT

Invoices will be issued via email on a per-job basis.

All invoices are due by the payment due date listed on the invoice. If full payment is not received by the due date, an additional 10% of the invoice may be charged.

'Meldon Media reserves the right to hold photos until full payment is received.

FOR FIRST-TIME CLIENTS:

All photo shoots receive a quote before the booking is confirmed. The Agent pays the invoice in full before the final images are delivered. Watermarked images can be provided for preview before payment. Upon receiving full payment, your photos will be delivered via a download link to your designated email address.

COPYRIGHT
  1. Don Shiel of Meldon Media retains all ownership/copyright of images taken. (Stills, Video and Floor Plans)
  2. Upon full payment of the invoice provided, Meldon Media gives you, the Client/Agent, a limited license to use its images for advertising and promoting their Client’s property for a limited time (a maximum of 6 months).
  3. If you, the Agent, sell or lose the listing, Meldon Media’s images cannot be passed on to another agent without express permission.
  4. The on-selling of Meldon Media’s products is strictly prohibited.

The real estate agent/agency is responsible for notifying the customer of these terms and conditions.
